Minimum Compensation for Wrongful Workplace Death Set at MVR 1.46 Million

The Labour Relations Authority (LRA) has established a new regulation mandating that employers compensate heirs with a minimum of MVR 1.46 million in cases of wrongful workplace death. This regulation, titled the Workplace Safety and Health Protection Regulation, came into effect last Wednesday and provides guidelines for compensation in cases of disability or loss of life due to workplace incidents.

According to the regulation, if an employee is injured at work or as a result of work-related activities, leading to temporary or permanent disability or death, the employee's family is entitled to compensation.

Compensation for Injuries Includes:

  • All medical expenses related to the injury
  • Wages for days absent from work due to medical treatment
  • Compensation for damages resulting from temporary or permanent disability
  • Compensation in the event of death caused by the injury

For permanent disabilities, compensation must be provided for ten years, with amounts ranging from MVR 1,260,000 to MVR 19 million, calculated based on age, degree of disability, and other factors.

In cases of death while at work, compensation is determined by the age, monthly income of the deceased, and the level of negligence by the employer. Even if the death occurs due to an accident without negligence, the employee's heirs are entitled to MVR 50,000. However, if negligence is involved, compensation can exceed one million Maldivian Rufiyaa.

Taking into account the degree of negligence, age, and wages of the employee, the minimum compensation amount is set at MVR 1.46 million, while the maximum compensation can reach up to MVR 15.4 million.

The regulation also outlines additional measures aimed at ensuring employee safety in the workplace.
